Promoter
1. The promoter for the Travelex “Win a Trip to Greater Palm Springs” promotion (“Promotion”) is Travelex Limited (ABN 36 004 179 953) of Suite 45.01, Level 45, 25 Martin Place, Sydney NSW 2000 Australia, and Travelex Financial Services NZ Limited (Company Number 115663) of Level 14 Augusta House, 19 Victoria Street, Auckland 1010 New Zealand (collectively referred to as “Promoter”).
2. The following organisations(collectively referred to as the “Promotional Partners”) will assist in the administration of the Promotion and supply of the prize: (i) Gate 7 Pty Ltd (ABN 13 082 107 088) of Suite 102, 13-15 Wentworth Avenue, Sydney, NSW 2000 Australia (“Gate 7”); (ii) Delta Air Lines of Level 5, 117 York Street, SYDNEY NSW 2000 and (iii) JW Marriott Desert Springs RESORT & SPA of 74-855 Country Club Drive, Palm Desert, California 92260.
Entry Requirements.
- Information on how to enter and the Prize (defined below) form part of these terms and conditions (“Terms and Conditions”). Participation in this Promotion is deemed acceptance of these Terms and Conditions.
- Entry is only open to Australian and New Zealand residents aged 21 years or over (“Entrant(s)”).
- Employees (and “Immediate Family” of Employees) of the Promoter, the Promotional Partners and agencies associated with this Promotion are ineligible to enter. “Immediate Family” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
- Entry into the Promotion will open at 9:00AM AEDT on 1 December 2025 and will close at 11.59PM AEDT on 30 January 2026 (“Promotional Period”).
- To be eligible to enter, individuals must purchase the equivalent of AUD$500 (for Australian Entrants) or NZD$500 (for New Zealand Entrants) or more of foreign currency in a single transaction by directly loading or re-loading the foreign currency onto a Travelex Money Card, at a Travelex store in Australia or New Zealand (including via https://www.travelex.com.au/ and https://www.travelex.co.nz/ or via the Australian or New Zealand Travelex Money App but excluding over-the-counter transactions at any Travelex stores located in arrival terminals at airports located in Australia and New Zealand) during the Promotional Period (“Qualifying Purchase”). “Foreign currency” means any currency other than AUD or NZD for the Travelex Money Card issued in Australia or New Zealand, respectively. Purchase of the Travelex Money Card is not available via the Travelex Money App.
- All Qualifying Purchases will be automatically entered into the draw, as set out below (“Entry(ies)”). Multiple Entries are permitted however each Qualifying Purchase can only be submitted once.
- Entries will be awarded according to the amount of foreign currency loaded or reloaded onto a Travelex Money Card in the Qualifying Purchase (in AUD or NZD, as applicable), in a single transaction during the Promotional Period, as follows:
- Entrants will be eligible to receive one (1) Entry for every $100 spent in a Qualifying Purchase (for example, Entrants who spend $500 will be eligible to receive five (5) Entries). For the avoidance of doubt, purchases of $499.99 and below will not be eligible to receive any entries.
- For clarity, Entries are rounded down to the nearest $100 (for example, Entrants who make a Qualifying Purchase between $700 to $799.99 will be eligible to receive seven (7) Entries in total).
- Entrants must retain a copy of their purchase receipt for the Qualifying Purchase as proof of purchase in order to claim their Prize. In the event a purchase receipt is not automatically provided to the Entrant at the time of making their Qualifying Purchase, it is the Entrant’s responsibility to request such material. Failure to produce the proof of purchase when requested may, in the absolute discretion of the Promoter, result in invalidation of an Entrant’s Entry and forfeiture of any right to the Prize. The purchase receipt must clearly specify the store of purchase and the date confirming that the purchase was made during the Promotional Period.
- The Promoter reserves the right, at any time, to verify the validity of Entries and Entrants (including an Entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the Entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
- Incomplete or indecipherable Entries, as determined by Promoter in its sole and absolute discretion, will be deemed invalid.
- If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.
- The draw will take place at Anisimoff Legal, Level 3, 162 Collins Street, Melbourne VIC 3000, Australia at 10:00AM AEDT on 11 February 2026. The Promoter may draw additional reserve Entries and record them in order in case an invalid Entry or ineligible Entrant is drawn. The winner will be notified in writing within two (2) business days of the draw and their details (first initial, surname and postcode) will be published online at https://www.travelex.com.au/ and https://www.travelex.co.nz/ on 25 February 2026.
- The Promoter’s decision is final and no correspondence will be entered into.
Prizes
14. There will be one (1) prize in total (“Prize”), being a trip for two (2) adults to Greater Palm Springs, USA, as further detailed below.
15. The first valid Entry drawn will win the Prize (“Prize Winner”). The Prize is a trip for two (2) adults (aged 21 years or older) to Greater Palm Springs, USA, valued at up to AUD/NZD$13,000 depending on date and point of departure. The Prize includes:
- Seven (7) nights' accommodation at the JW Marriott Desert Springs RESORT & SPA for two (2) adults valued up to AUD $3,500;
- Two (2) economy class return flights in main cabin with Delta Airlines departing from either Sydney, Melbourne or Auckland, valued up to AUD $5,000 (awarded as a flight voucher);
- Transport and activities valued up to AUD $3,500 including: daily breakfast; car hire for seven (7) days with pick up and drop off from LAX Airport; desert jeep tour to the San Andreas Fault; Palm Springs aerial tramway tour; architectural tour with Palm Springs Mod Squad; BMW Performance Centre West driving experience; and
- a $1,000 USD-denominated Prepaid card (“Travelex Money Card”) for the Prize Winner only.
The following conditions apply to the Prize:
16. The Promoter accepts no responsibility for any variation in the value of the Prize or part of it.
17. Flights are subject to seasonal availability. The Prize Winner must make their own way to an eligible departure city (Sydney (SYD) or Melbourne (MEL) or Auckland (AKL)) at their own cost. All flights must be booked online through the airline partner, and the Prize Winner is responsible for any ancillary costs associated with the flight. The Prize Winner acknowledges that Delta flights from New Zealand run seasonally and if the Prize Winner wishes to depart from Auckland (AKL), only limited dates will be available for travel. If a New Zealand based Prize Winner wishes to travel on a date which is not available with an AKL departure, the Prize Winner (and the Prize Winner’s guest) will need to travel to SYD or MEL Airport (at their own cost) in order to depart from one of those airports.
18. Additional spending money, additional meals, taxes (excluding airline and airport taxes), insurance, transport to and from departure point, additional transfers, passports, visas, items of a personal nature, in-room charges and all other ancillary costs are not included. The Prize must be used within 12 months of the draw date (this means the holiday must be completed and the Prize Winner and the Prize Winner’s guest must return to their departure point by 30 January 2027) and is subject to booking, regardless of preferred flight availability.
19. Unless otherwise approved by the Promoter, the Prize Winner and Prize Winner's guest must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Itinerary is subject to change and may be adjusted depending on location, departure city, flight schedule or other factors.
20. The Prize is subject to the standard terms and conditions of individual Prize and service providers and the Promotional Partners.
21. Any ancillary costs associated with redeeming the Delta Airlines flight voucher and Prepaid Travelex Money Card are not included. Any unused balance of the Delta Airlines flight voucher and Travelex Money Card will not be awarded as cash. Redemption of the Delta Airlines flight voucher and Travelex Money Card is subject to any terms and conditions of the issuer including those specified on the Delta Airlines flight voucher and/or Travelex Money Card.
22. The Prize Winner may be required to present their credit card at time of accommodation check in. A deposit may be required from the Prize Winner at check-in to the hotel and this is not included in the Prize.
23. Prize Winner and Prize Winner's guest are advised to check government travel advice before booking and embarking on any travel and are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and other travel documentation (including, without limitation, proof of COVID-19 vaccination in an appropriate form, if required) at their own cost. During the travel, the Prize Winner (and Prize Winner’s guest) must comply with any mandatory travel requirements, such as wearing face masks during flights if requested, customer service counters and kiosks, airport lounges, gates and baggage claim areas at both the origin and destination airports.
24. Travel must be completed outside of any blackout periods which apply during school holidays and public holidays in New Zealand and/or the Australian State or Territory of departure. Blackout dates are as follows: Jan 12, 16-17, 25-26, Feb 1-2, 23 & 24, March 3-14, 22-24, April 10-12, 14-19, 24-26, May 10-11, 22-24, Jul 10-11, Aug 18, Oct 7, 19-20, 25-26, Nov 17-18, Dec 3-4 2026 and Jan 10-12,15-17 2027.
25. The Prize Winner must book the flights directly with Delta Air Lines. The flight voucher for two (2) Main Cabin economy class) return flights with Delta Air Lines is valid for booking class DL and is subject to any additional terms and conditions stated on the voucher. Flight reservations must be made, and tickets issued prior to departure. Tickets must be issued within 24 hours of making reservations. Reservations made on delta.com must be ticketed at time of reservation. The number of seats available for this offer is limited.
26. Flight certificate expiration is as of midnight Eastern Standard Time on 31 December 2026. Flights must be booked and ticket issued by 31 December 2026. Extensions will not be granted under any circumstances.
27. Unless otherwise approved by the Promoter, tickets for travel are valid for roundtrip flights between the origin and destination only, using the most direct routing from the eligible departure city. Stopovers, upgrades, and name changes are not permitted. Lost or stolen tickets and/or certificates will not be replaced.
28. The flight voucher is transferable only if it is not associated with an individual’s name. Exception: If the voucher is issued in an individual’s name, the voucher may be used by a different person as long as the original recipient is travelling with that person in the same reservation. Voucher may not be transferred for cash or any other consideration. Purchased and/or auctioned vouchers are subject to confiscation and travel will not be permitted.
29. Flights are not eligible for frequent flyer mileage accrual. Travel may be restricted at certain times of the year due to heavy demand on services.
30. Once flights are ticketed, tickets are non-refundable after the risk free cancellation period expires. Changes are permitted free of charge, provided the new itinerary meets all provisions of the program and the same class is available to rebook. Any difference in taxes will need to be paid.
31. Standard baggage fees apply and are the responsibility of the Prize Winner and the Prize Winner’s guest.
32. The program itinerary and details of the Prize are at the discretion of the Visit Greater Palm Springs team and are subject to change.
33. Neither the Promoter nor the Promotional Partners manage the Prize Winner or the Prize Winner’s guest’s visa application process or any COVID-19 entry requirement processes required by the destination country in which the Prize is to be taken. All visa and COVID-19-related issues must be handled by the Prize Winner. Should a Prize Winner be denied a visa or entry into the destination country due to COVID-19, an alternative Prize Winner will be drawn, if timing permits, and the Prize Winner forfeits any right to the Prize.
Additional Terms for Flight Certificate
34. All terms and conditions associated with the Delta Flight Certificate, as outlined in the accompanying document, also apply to the flight component of this Prize. In the event of any inconsistency between the terms in this document and those contained within the Delta Flight Certificate, the terms of the Delta Flight Certificate will prevail with respect to the flight component only.
35. If, for any, reason the Prize Winner does not take the Prize by 09:59AM AEDT on 25 March 2026 the Promoter, then the Prize will be forfeited. The Promoter reserves the right to award the Prize to a reserve Entrant drawn, if an originally drawn Prize Winner is ineligible. The original Prize Winner will not be entitled to a refund or credit note for the travel.
36. If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a Prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
37. Total Prize pool is valued at up to AUD/NZD $13,000.
38. The Prize, or any unused portion of the Prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
39. A draw for the Prize, if unclaimed, (“Unclaimed Prize”) may take place on 25 March 2026 at the same time and place as the original draw, subject to any directions from a regulatory authority. The first valid Entry drawn and successfully contacted by phone and in writing will win the Unclaimed Prize. If the Unclaimed Prize winner cannot be contacted within 48 hours, the Promoter will contact the next drawn winner until an Unclaimed Prize winner is determined. The Unclaimed Prize winner, if any, will be notified in writing within 48 hours days of the draw and their details (first initial, surname and postcode) will be published online at https://www.travelex.com.au/ and https://www.travelex.co.nz/ on 1 April 2026.
General
40. In the event of war, terrorism, state of emergency or disaster, pandemic, or other events causing disruption to travel, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or suspend or modify a Prize, subject to any written directions from a relevant regulatory authority.
41. The Prize Winner and otherwise Unclaimed Prize winner (collectively, “Winner”) consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome).
42. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
43. Any cost associated with accessing the Promotion website is the Entrant’s responsibility and is dependent on the internet service provider used.
44. As a condition of accepting the Prize, the Winner (and his/her guest) must sign any legal documentation as and in the form required by the Promoter, the Promotional Partners and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
45. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Promotional Partners (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
46. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, and without limiting any exclusion of liability set out herein, the Promoter and Promotional Partners (including their respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s and/or Promotional Partners’ control); (b) any theft, unauthorised access or third party interference; (c) any Entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) if a tour or travel activity is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter or Promotional Partners; (f) any tax liability incurred by a Winner or Entrant; (g) use or taking of a Prize or participation in a Prize; or (h) the Promotion or any Prize.
47. The Promoter collects personal information ("PI") in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its “Privacy Policy”, which can be viewed for Australia at www.travelex.com.au/product-disclosure-documents-and-terms-conditions/privacy-policy and for New Zealand at https://www.travelex.co.nz/product-disclosure-documents-and-terms-conditions/privacy-statement. The Privacy Policy also contains information about how Entrants may opt out, access, update or correct their PI, how Entrants may complain about a breach of the Australian or New Zealand Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter may disclose PI overseas - see Privacy Policy for details.
48. By accepting these terms & conditions you agree to receive information on the Promoter’s products and services (including products and services offered by our third-party partners on our website or in-store). Your information will be treated in line with Travelex’s privacy policy which can be viewed for Australia at www.travelex.com.au/product-disclosure-documents-and-terms-conditions/privacy-policy and for New Zealand at https://www.travelex.co.nz/product-disclosure-documents-and-terms-conditions/privacy-statement.
